21. | GUARANTEE WITHIN 7 DAYS PERIOD |
21.1 | 21.1 If any breakdown or dysfunction occurs within the 7 days following the Product reception by the client, this latter should contact LINKCOM Clients Department that will indicate him the procedure to follow to return the Product. |
21.2 | No return will be accepted without the prior approval of LINKCOM Clients Department. Such approval is materialized by the delivery of a return number according to the procedures and provisions mentioned in the Return Process. |
21.3 | No product, the functioning of which appears to be defective after the elapse of 7 workable days following the reception of the Product by the Client, will be taken in charge by LINKCOM. |
22. | GUARANTEE AND DISTRIBUTORS |
22.1 | In case of figures where LINKCOM acts as Distributor Intermediary, LINKCOM supplies no contractual guarantee with regard to the Products. |
22.2 | The only guarantee to which LINKCOM is liable is the legal guarantee stipulated in Articles 1641 to 1649 of the Civil Code. |
22.3 | The eventual contractual guarantee given by the manufacturer commits only this latter.

22.4 | In no cases LINKCOM, guarantees only the supplied merchandises to be declared fit to respond to any particular problem relating to the user activity. |
22.5 | Are excluded from any guarantee:
- Any consumables included to the sold products - Any defaults of use or maintenance - Any deterioration due to an error of manipulation , to an abusive or abnormal use - The spare parts

22.6 | LINKCOM shall not assume any indemnification toward users or third parties for any consequence of the use of the merchandise, for direct or indirect damages, people accidents, damages to any distinct property of our equipment, any profit loss or loss of earnings, any damages generated or to be generated from any deterioration. The client being aware of the product technical characteristics has made his selection of the products of his order at his own responsibility according to the needs he determined. So LINKCOM guarantees not the appropriateness or the aptitude of the products to serve to the Client needs or to his Client and/or to a determined or particular use to which this latter indicates them. |
22.7 | In general and in the hypothesis that the LINKCOM responsibility will be engaged and finally retained due to any fault incumbent personally, exclusively and directly upon it, LINKCOM shall not compensate for any indirect, commercial or immaterial prejudice suffered by the Client. The financial responsibility of LINKCOM shall be in any case limited to the reimbursement of the price paid by the client for the purchase of the concerned property.

22.8 | The guarantee is limited, at the option of LINKCOM, to the reimbursement , reparation or replacement by an equivalent equipment. It shall not apply in the following cases: |
22.8.a | Normal wear and tear of the products |
22.8.b | Deterioration or accidents that result from the maintenance default and particularly breaking, breakage, humidity, inadequate temperature, oxidation, liquid infiltration. |
23. | The Guarantee of the Manufacturer LINKCOM |
23.1 | The Manufacturer's Guarantee is tacitly included for the purchase of the Product. Its duration is for one year from the delivery date. Such guarantee does not concern the products of reduction of stock purchased on LINKCOM site. |
23.2 | The Manufacturer's Guarantee is tacitly included for the purchase of the Product. Its duration is for one year from the delivery date. Such guarantee does not concern the products of reduction of stock purchased on LINKCOM site. |
23.3 | If any breakdown occurs after the 7 days following the reception date of the Product and within the period of the manufacturer's guarantee appearing on the Product voucher, the Client should refer to the After Sale Department of the Product Manufacturer. |
23.4 | The Client may in such case contact the Clients Department of LINKCOM that will devote its best efforts to supply him with the address and telephone number of the After Sale Department of the Product Manufacturer. |
23.5 | The replacement of any defective product is subject to the acceptance of the said product by the Manufacturer that is exclusively apt to judge the failure cause of the product. |
23.6 | LINKCOM may not be in any case hold responsible of the acts and decisions of the Manufacturer's After Sale Department . As for example LINKCOM may not take in charge the return of any Product that the Manufacturer's After Sale Department refused to take it in charge for whatsoever will be the reason: Manufacturing fault, chock during the transport, misuse of the Product, etc. |
23.7 | Are excluded from any guarantee:
- Any consumables included to the sold products - Any defaults of use or maintenance - Any deterioration due to an error of manipulation , to an abusive or abnormal use - The spare parts |
23.8 | During the Export, the guarantee management may take the form of extra merchandise representing 1% of the acquired quantities.

24. | Guarantee of Products in REDUCTION OF STOCK or REPACKED |
24.1 | The guarantee of the Products in reduction of stock s limited to three months. |
24.2 | The guarantee of the REPACKED products is for six months.

24.3 | Beyond such respective guarantee neither product will be retaken or exchanged.
